THE US HAS ADDED RUSSIAN WEBSITES AND SOCIAL MEDIA TO THE LIST OF DISTRIBUTORS OF COUNTERFEIT AND PIRATED PRODUCTS

At the end of 2024, after the publication of the bill "On the platform economy" aimed at regulating Russian marketplaces in the fight against counterfeiting, TKM covered this governmental initiative in detail at a meeting of the working group at the American chamber of commerce in Russia (AmCham).

Then, in early January 2025, US Trade Representative Katherine Tai delivered a report on piracy and illegal use of trademarks, specifically noting the vulnerability of American copyright holders facing the financial damage to businesses, and called on trading partners "... to join us in the fight against counterfeit and pirated goods." The fact is that since 2022, many IT platforms that post ads for the sale of both physical goods and digital content have not fulfilled requests from US copyright holders to remove pirated materials and products that violate laws. This includes marketplaces, social media, file sharing platforms, online libraries and other similar services.

Robert Agee, the President of the American Chamber of Commerce in Russia, is pleased to comment on the problem of Western copyright holders: “The “platform economy” and digital marketplaces in Russia are developing so fast that a legal framework is not yet in place. For us, as a business association uniting companies with original brand manufacturers and major trade mark owners, trade mark and IP rights protection regulation are of the highest importance. AMCHAM, together with these companies, discuss the issues and suggest regulatory changes that assist in the protection of their IP rights.”
