One of the most discussed brands that has exited the Russian market in 2022 is Coca-Cola. Since then, the original drink has been available in retail due to supplies from Iran, Azerbaijan, and other countries (data from "Infoline-Analytics").
Nowadays, according to reports, the rights holder is preparing to return to Russia, internally discussing strategies to deal with competitors.
The trademark was included in the Customs register of IP objects of Russia (TROIS) until 2022, but the registration was not prolongated due to the brand’s withdrawal from the market, that meant termination of import.
Indeed, this brand is currently not on the list of authorized parallel import products. Thus, once it is integrated into the TROIS system, it will automatically benefit from protection, and any parallel import will need to be authorized by the rights holder. It is therefore clear that the first step for Coca-Cola will be to register its trademarks in the TROIS in order to effectively combat parallel imports and counterfeits.
What about the IP rights protection in the national register, the rights holder The Coca-Cola Company extended its exclusive rights registration in Rospatent until 2032. Our specialists say, that such measures will assist the rights holder in returning to the Russian market, favoring to regain previous positions, maintaining reputation, and successfully combating lookalikes and counterfeits, as local producers catch opportunities to capitalize on the success of this globally recognized beverage brand.
Additionally, recently a Novosibirsk company, PKV, began approaching retailers with offers to supply beverages under the Coca-Cola brand, produced by a company registered in South Ossetia called "Coca-Cola Company." The product label, according to visual comparisons, is nearly identical to the original. Presumably, due to legal and reputational risks, it is unlikely that major retail chains will dare to purchase this product.
