Continuing the series of articles about the return of foreign brands to the Russian market, TKM informs rights holders about new measures that the government is currently elaborating.
Recently, the Ministry of Finance of the Russian Federation approved a draft law that provides for the possibility of foreign companies returning their assets, but only with the consent of the new owner and relevant authorities. However, the possible reasons for refusal are:
• the company is registered in a country that is unfriendly to Russia;
• more than two years have passed since the transaction;
• the buyback agreement specifies a price below market value;
• the company's activities are in strategically important sectors affecting the socio-economic stability of the country;
• particularly important assets in defense or financial sectors can only be returned by decision of the President of the Russian Federation.
The draft law also provides for the possibility of compensation in case of refusal to return assets to foreign investors, the amount of which is determined by the Government or the court. Nevertheless, if a company has not fulfilled its obligations before leaving the Russian market, the compensation amount may be reduced.
