HOW PARALLEL IMPORT OPENED THE DOOR TO COUNTERFEITING

At the meeting of the Food/FMCG committee held on April 17, 2025, at the American Chamber of Commerce in Russia (AmCham), plans by the Ministry of Industry and Trade to reduce the number of brands included in the list of goods permitted for parallel import were discussed.

Visita Shidaev, a senior specialist at TKM in intellectual property rights protection concerning customs regulation, presented a report titled “How Parallel Import Opened the Door to Counterfeiting.” He explained that even if a brand is included in the parallel import list, it is crucial to register and timely renew trademark registrations in the Customs Register of Intellectual Property Objects (TROIS) so that officials from the Federal Customs Service of Russia (FCS) can notify the rights holder about attempts to import counterfeit goods into Russia and suspend the cargo. Visita emphasized that “even if counterfeit goods are being brought into the country under the guise of originals using forged documents within the framework of parallel imports, customs officials will identify signs of counterfeiting, which TKM regularly provides them.”

Regarding products in the Food/FMCG segment, Visita presented examples of several brands whose volumes of counterfeit products have increased by more than 40% since the beginning of 2022.
