Today, 6 months after, we witness the efficiency of that act, as the IP rights of the brand are infringed in a large scale.
Recently, law enforcement officers detected an illegal workshop for the production of Coca-Cola and Pepsi in the city of Khimki. According to the source, the warehouse contained 32K liters of counterfeit drinks, poured into 16K two-liter bottles with stickers of the brands mentioned.
In addition, the police found equipment for bottling, capping and packaging products. Currently, law enforcement agencies are deciding whether to initiate a case under the article "Illegal use of means of individualization of goods".
TKMInternationalConsulting specialists draw the attention of copyright holders to the fact that in the conditions of suspension of activities or complete withdrawal from the Russian market, many brands become even less protected, since they neglect to renew the registration of trademarks belonging to them.
Upon expiration of the registration in Rospatent and in the customs register (TROIS), the protection of the trademark in Russia ceases. Competitors can take advantage of this and register even a world-famous brand name for themselves. Also, the lack of registration of a trademark will not allow achieving the maximum possible degree of liability and financial compensation for illegal use of a trademark. To conclude, in case of no renewal of trademark registration in Rospatent, the trademark could be annulated and the world known drink would have been transferred to another owner.
