I want my trademark to be registered with Rospatent. How long will the protection of my trademark last?
The exclusive right to a trademark is valid for ten years from the date of filing an application with Rospatent and the rights holder may renew the registration an unlimited number of times. However, #TKM recommends to do so within the last year of the exclusive right’s validity.
What happens if I don’t renew my trademark registration?
If the registration is not renewed and ten years have passed since the last registration, the legal protection of the trademark will cease to be valid. We underline, however, that doing business under a trademark with an expired registration promises great risks. Financial #investments that have been poured into brand promotion and its #reputation may be exploited by competitors or patent trolls who might claim money for the business owner to have the chance to use the trademark that had once belonged to them.
I was late to renew my trademark registration, but I do not want to lose my exclusive rights to it. What should I do?
In order to reobtain the exclusive right to the trademark, you will have to apply for registration again, but this time you may be refused, considering that similar trademarks might have appeared in the Register, and their legal protection will be in a priority.
